Proposition 65 Warning


As you may or may not be aware, the requirements for product warnings under California’s “Safe Drinking Water and Toxic Enforcement Act of 1986,” also known as “Proposition 65,” have changed and will go into effect August 30, 2018. These new regulations impose additional obligations on both manufacturers, supply-chain partners, including product distributors & retailers. The new regulations are included in the California Code of Regulations, Title 27, Article 6.

What is Prop 65?

Prop 65 applies to any company operating in California, selling products in California, or manufacturing products that may be sold in or brought into California. It mandates that the Governor of California maintain and publish a list of chemicals known to cause cancer, birth defects, and/or other reproductive harm. The list, which is updated annually, includes hundreds of chemicals found in many everyday items. The purpose of Prop 65 is to inform the public about exposure to these chemicals.

Prop 65 does not ban the sale of products containing these chemicals but instead requires warnings on any product, product packaging, or literature with the product. For more information on Prop 65

Why does Wind-Lock include a Prop 65 warning?

Wind-Lock has chosen to provide consumers with as much information as possible so that they can make decisions about the products they buy and use. Please understand that not all products Wind-Lock distributes have chemicals listed on Prop 65 warning list.

Starting August 30th, 2018 Wind-Lock will display the below warning in the following fashion

  • Affix warning label on shipping pallet, shrink wrap, containers, boxes, packing slip, and individual items when able for materials to California

  • Display on customer invoices and Wind-Lock website

As you know, Wind-Lock is not a manufacturer. However, Wind-Lock has taken a proactive approach to protect our clients and customers. Wind-Lock has contacted all manufacturers we conduct business with to inform them of California’s “Safe Drinking Water and Toxic Enforcement Act of 1986,” also known as “Proposition 65,” as they are the sole source of providing information about chemicals they use when producing their products.
